Proposition 65 Warning

The Safe Drinking Water and Toxic Enforcement Act of 1986 (commonly known as Proposition 65) is a California law designed to protect California citizens from chemicals known to cause cancer or birth defects or other reproductive harm and to inform citizens about exposure to such chemicals. Acrylamide is one such chemical that may be found in coffee, including coffee sold by Csspkj Coffee. Acrylamide is a natural byproduct formed when certain sugars and amino acids react at high temperatures, such as when coffee is roasted. The U.S. Food and Drug Administration (FDA) has not determined whether the low concentrations of acrylamide naturally present in roasted coffee pose any public health risks. Governing Law and Jurisdiction

All matters relating to our website and these Terms, and any disputes or claims arising therefrom or related thereto (in each case, including non-contractual disputes or claims), will be governed by and construed in accordance with the laws of the State of California, without regard to any choice or conflict of law provisions. Any legal action, suit, or proceeding arising out of or related to these Terms or our website shall be brought exclusively in the federal and state courts located in Orange County, California. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Dispute Resolution and Binding Arbitration.

(a) You and Csspkj COFFEE agree to waive any right to participate in a class or representative action in connection with any claim. Any claim, dispute, or controversy between you and us arising out of or relating to your purchase of products or services through this Website (whether in contract, tort, or otherwise, whether pre-existing, present, or future, and including statutory, consumer protection, common law, intentional tort, injunctive, and equitable claims) will be exclusively and finally settled through binding arbitration. (b) The arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect ("AAA Rules"), except as modified by this Section 12. (The AAA Rules are available by contacting the AAA at 1-800-778-7879.) The interpretation and enforcement of this section will be governed by the Federal Arbitration Act. The arbitrator shall have exclusive authority to resolve any dispute regarding the arbitrability and/or enforceability of this arbitration provision, including any challenge to the inequity of any arbitration clause or agreement, including any challenge that the arbitration clause or agreement is void, voidable, or otherwise invalid. The arbitrator shall have the authority to grant any relief available in court under law or in equity. Any award rendered by the arbitrator shall be final and binding upon all parties and may be entered as a judgment in any court of competent jurisdiction. If you prevail on any claim requiring attorneys' fees to be paid by the prevailing party, the arbitrator may award you reasonable fees based on the statutory fee-shifting standards. (c) You may choose to pursue a claim in small claims court rather than arbitration if you notify us in writing of your intent within 60 days of your purchase. Arbitration or small claims court proceedings will be limited to your individual dispute or controversy. (d) You agree to arbitrate on an individual basis. In any dispute, neither you nor REBORN COFFEE will be entitled to join or consolidate claims brought by or against other customers in court or arbitration, or to participate in any claim as a class representative, class member, or private attorney general. The arbitration tribunal may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitration tribunal will not have the authority to review the enforceability of this class arbitration waiver, and any challenge to this class arbitration waiver may be brought only in a court of competent jurisdiction. If any provision of this Arbitration Agreement is held unenforceable, such unenforceable provision will be severed and the remaining arbitration provisions will be enforced.

Waiver and Severability

No waiver by Csspkj Coffee of any term or condition set forth in these Terms will be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and Csspkj Coffee's failure to assert a right or provision under these Terms will not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision will be eliminated or limited to the minimum extent possible, and the remaining provisions of these Terms will continue in full force and effect.

Recurring Subscriptions

By starting a Csspkj subscription, you agree to be billed on a recurring basis until your subscription is either a) canceled or b) suspended. If suspended, your subscription will remain suspended until your requested reinstatement date; if no reinstatement date is specified, your subscription will remain suspended indefinitely.

You can cancel your subscription at any time by contacting our customer service team via our website, phone, or email. If canceling by phone or email, please allow up to 72 hours for cancellation.

You will be charged the same fee for each order generated by your subscription, unless your subscription configuration changes. This includes canceling your subscription and starting a similar subscription later.

Your subscription periodThe terms are continuous.

Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Csspkj Coffee with respect to our Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties (whether written or oral) with respect to our Website.
